The article analyzes the main directions of the implementation of the principle of adversarial parties in the consideration of a criminal case in a simplified criminal procedure form, which is expressed in the application of a special procedure of legal proceedings with the consent of the accused with the indictment. The author resolves a number of controversial issues related to the operation of the adversarial principle not only in the case of non-recognition of the accused’s guilt in the crime committed, but also in the situation of its full recognition. The possibility of applying a special procedure in case of disagreement of the accused with the claims in a criminal case is considered. The article analyzes the features of the implementation of the principle of adversarial parties in a special procedure of legal proceedings, when the accused agreed with the charge, and the defense lawyer objects to this against the will of the latter. Optimization of the defender’s actions in such a situation is extremely relevant, and therefore possible options for his actions are considered.
