Abstract (English):
The article examines the issues of the possibility of differentiation of criminal liability for petty bribery depending on the form of the act – receiving and giving a bribe in an amount not exceeding 10 thousand rubles, as well as the presence of qualifying signs used by the legislator in the norms provided for in Articles 290, 291, 291.2 of the Criminal Code of the Russian Federation. Special attention is paid to determining the status of bribery “for illegal actions (inaction)” and the validity of establishing criminal liability for it. The analysis of the scientific literature, the norms of the Russian criminal legislation on responsibility for bribery in their historical development, judicial practice and statistical data of the Judicial Department at the Supreme Court of the Russian Federation allowed the author to give positive answers to the questions posed and offer his own version of Article 291.2 of the Criminal Code of the Russian Federation “Petty bribery”.
