The article deals with the issues of the adversarial principle in the criminal proceedings of the Russian Federation. The scope of the adversarial principle in the pre-trial stages of the criminal procedure is analyzed. The controversial issues of the implementation of judicial control over the bodies of preliminary investigation are considered, it is claimed that the court does not resolve the dispute, but checks and evaluates the legality of the petitions of the bodies of preliminary investigation. It is argued that the court should take into account the positions of both the prosecutor and the investigator, if the approaches of these participants in the proceedings do not coincide. The legitimacy of referring the investigator to the side of the prosecution is substantiated, attention is focused on the fact that the implementation of the function of the prosecution is incompatible with the accusatory bias.
