LEGAL BASIS, DEADLINES, AND PROCEDURE FOR ACTIVITIES IN CRIMINAL CASES OF PAST YEARS

Abstract:
This article examines legal issues that complicate the investigation of criminal cases involving crimes of the past. Statistical data on unsolved crimes of the past, cases terminated due to the expiration of the statute of limitations for prosecution, solved crimes of the past, and unsolved crimes from 2018 to 2025 are analyzed. The legal basis, procedural deadlines, and specific features of the criminal procedure for this type of criminal case are analyzed. Recommendations on the key elements of preliminary investigations for criminal cases involving crimes committed in the past are formulated and proposed. These provisions attempt to create a comprehensive foundation for the preliminary investigation of criminal cases involving crimes in this category. Therefore, it is advisable to improve regulatory framework, including those governing certain procedural actions, group investigations, interactions with services and units, and procedural oversight, which are all mandatory for these criminal cases. The most rational and comprehensive mechanisms for resolving issues related to the investigation of criminal cases concerning crimes committed in past years have been identified.
