THEFT OF STOLEN GOODS. CONTROVERSIAL ISSUES OF CRIMINAL LAW CHARACTERISTICS

Abstract (English):
This work is devoted to the theoretical and applied problem of the qualification of acts related to the mercenary, illegal, gratuitous seizure of property from the owner, who does not legally possess such property and is not the owner. The analysis of the scientific legal literature shows the lack of a unified theo- retical position on the criminal law characteristics of such acts. As a result of the content analysis of publicly available databases containing judicial acts and court decisions, it was not possible to find any judicial practice of making decisions on these facts. Empirical evidence indicates the prevalence of such acts in the criminal environment, but they do not find any legal assessment by law enforcement agencies. The author considers various scientific positions on this issue, describes the results of the conducted research on law enforcement practice and concludes that it is necessary to amend criminal legislation.
