TACTICAL FEATURES OF THE USE OF PREVENTIVE MEASURES IN THE FORM OF DETEN- TION IN THE INVESTIGATION OF FRAUD COMMITTED USING INFORMATION AND TELECOMMUNICATION TECHNOLOGIES

Abstract (English):
The article is devoted to a detailed analysis of the tactical aspects of the use of preventive mea- sures in the form of detention in the context of the investigation of crimes related to the use of information and telecommunication technologies. The author examines the current trends in the growth of cybercrimes in the Russian Federation and emphasizes the need for thorough preparation of investigators for conducting investi- gative actions and making procedural decisions. Particular attention is paid to the analysis of factors influencing the decision to apply detention, including the severity and nature of the crime, as well as the personality characteristics of the offender and his post-criminal behavior. Typical investigative situations requiring the use of this preventive measure are highlighted, and its effectiveness in suppressing negative actions provided for in Article 97 of the Criminal Procedure Code of the Russian Federation is substantiated. It is noted that the competent implementation of such a preventive measure as detention contributes not only to its lawful and reasonable application, but also to the achievement of a systemic tactical effect that can transform an unfavorable investigative situation into a favorable one. Examples of situations where the use of this preventive measure may be most appropriate are given, and the mechanisms of its effect on the suspect or accused, accomplices in the crime or persons assisting them are described.
