This article presents a brief analysis of the processes taking place in legal science in general, and in theoretical and historical studies in particular. The author focused on identifying the key needs and problems hindering its development. The main criticisms of legal science concern its subject matter, which is largely defined by the rapidly changing framework of legislation. This circumstance significantly diminishes the value of scholarly research. Theoretical and historical legal sciences have, in fact, ceased to perform their methodological functions, focusing primarily on artificially created problems. According to the author there is a direct link between the current state of legal science and negative trends in the higher education system that have not been overcome to date, since the main resource of science lies in its personnel potential.
