PROBATION AND ADMINISTRATIVE SUPERVISION AS MEASURES TO PREVENT THE RE-COMMISSION OF CRIMES

Abstract (English):
The article examines the institution of probation in conjunction with administrative supervision as elements of a preventive system for the re-commission of crimes. Probation and administrative supervision form a set of measures aimed at comprehensive support for former convicts and, accordingly, a system of administrative supervision aimed at monitoring certain groups of former prisoners. Probation provides for a range of measures, including assistance in employment, providing access to medical, educational and social assistance, as well as providing legal and psychological support to both those persons preparing for release and those already released. The author provides an overview of problematic issues of probation, among which the key problem is the lack of a systematic approach in the legal regulation of all types of probation. The existing imperfections of a legal and methodological nature necessitate a systematic approach to supporting former convicts through the development of the probation system, which should contribute to effective adaptation, social rehabilitation and reduction of recidivism.
