The article provides a comparative legal analysis of the provisions of the Code of the Russian Federation on Administrative Offenses and the Draft of the legal act in question, in order to identify short stories, their critical analysis, to form the author’s vision of the positive and negative aspects of the developed norm with the possibility of making adjustments, due to the non-entry into force of the Draft code. In addition, the authors of the article conduct a comparative analysis of the provisions of the considered elements of administrative offenses in terms of the effectiveness of existing legal norms, through the prism of improving road safety. The analysis carried out contributes to the systematization of the composition of administrative offenses in the field of traffic and the possibility for law enforcement agencies, based on these generalizations, to respond in a timely manner to such compositions.
