Apartments as a type of real estate are often used for living, but in the legislation this object is defined as non-residential premises. In this regard, the question arises about the possibility of placing apartments in a residential multi-apartment building and dividing apartments into residential and non-residential, as well as about changing civil and housing legislation - supplementing with new provisions on the specified object of civil legal relations. The article examines current issues of protecting civil rights and liability in the implementation of the protective function of civil law in relations regarding apartments as a type of real estate.
