THE FUNCTIONING OF LAW IN A CONSERVATIVE WELFARE STATE AND IN A WELFARE STATE OF THE SOCIAL-DEMOCRATIC TYPE: COMPARATIVE ANALYSIS

Abstract:
The article examines the general and specific features that are typical for the functioning of the law of welfare states of two types: conservative and social-democratic. The author’s principled position is the opinion that the functional characteristics of law are irreducible to the description of its inherent functions. Therefore, the law of a conservative welfare state and the law of a welfare state of a social-democratic type are compared in a number of parameters, namely in terms of their purpose, tasks, functions and dysfunctions. It is demonstrated that the law of welfare states of the types under consideration unites a common purpose, a number of common tasks and similar functions. The specific in the functioning of the law in the states of the types under consideration manifests itself in the implementation of special tasks by the law, in the different content of its functions and in the different significance of these functions for state policy, in various dysfunctional manifestations of law.
