Авторами сделан комплексный анализ деятельности следователя до и после уклонения лица от уголовной ответственности. Уделено внимание проблемам разграничения разыскных полномочий между следователем и органом дознания. Представлена авторская позиция относительн организационных и процессуальных аспектов задержания разыскиваемого преступника вне места производства по уголовному делу, поскольку законом порядок в подобных ситуациях не регламентирован и предложены возможные пути решения возникающих в этой связи проблем. Акцентируется внимание на деятельности по избранию меры пресечения в отношении разысканного. Поднимается вопрос о необходимости разработки научно обоснованных практических рекомендаций по взаимодействию должностных лиц при розыске скрывшихся обвиняемых.
The authors made a comprehensive analysis of the investigator’s activity before and after a person’s evasion of criminal liability. Attention is paid to the problems of delimitation of investigative powers between the investigator and the body of inquiry. The author's position is presented regarding the organizational and procedural aspects of the detention of a wanted criminal outside the place of criminal proceedings, since the law does not regulate the procedure in such situations, and suggests possible solutions to the problems being arised. Attention is focused on the activities of choosing a measure of restraint in relation to the wanted. The question is raised about the need to develop evidence-based practical recommendations on the interaction of officials in the search for fugitive indictees.
